Terms of Service

1. About these Terms
These Terms of Service ("Terms") govern your use of the Construction Competency Passport for Mechanical Services platform ("CCP-M", "the Service"). By creating an account or using CCP-M you agree to these Terms.
2. Accounts and eligibility
One person, one passport. You may not create duplicate accounts. Employer administrators must have authority to bind their organisation. You are responsible for the accuracy of information you submit and for keeping your credentials secure.
3. What CCP-M is — and is not
CCP-M is a competence management platform. It surfaces evidence, produces reports and applies the SKEB scoring model to support competence decisions. CCP-M does not itself certify individuals and does not replace employer, Principal Contractor, or regulator judgement. Safety-critical decisions remain the responsibility of duty holders.
4. Employer–worker relationship
Workers own their passport for life and may share it between Employers. When a Worker joins an Employer's workspace both parties consent to that Employer viewing the Worker's records for the duration of the link. Consent may be revoked by either party at any time.
When the link ends, the Employer retains an immutable snapshot of records duty-holder law requires them to keep. The Worker keeps the underlying records on their passport.
5. Immutable records
Behaviour assessments, project completions, verifications and stored competence scores are immutable once submitted. Corrections are made by superseding records, not by editing or deletion. This is a design requirement of the "golden thread" under the Building Safety Act 2022.
6. Subscriptions and billing
- Workers: free tier (card wallet). Passport Plus £12/year unlocks full SKEB scoring.
- Employed Workers: Plus features are covered by the Employer's subscription while the link is active. On lapse, the score freezes read-only and the wallet remains free.
- Contractors: one month free, then a monthly base fee plus £1 per assigned Worker per month.
- Fees are payable via Stripe. Failed payments may result in read-only access until resolved.
7. Acceptable use
You must not:
- Upload forged or misleading evidence.
- Impersonate another person or misrepresent your role.
- Attempt to circumvent RLS, audit logging, or the immutability of records.
- Scrape, resell or redistribute the Service or its data without a written agreement.
8. Intellectual property
CCP-M and its software, design system, assessment content and question banks are owned by us. Evidence you upload remains yours; you grant us a licence to store and process it for the purposes of delivering the Service.
9. Availability and support
We aim for high availability but do not guarantee uninterrupted access. Planned maintenance is announced in advance where practicable. Support is available at support@competenceid.com.
10. Liability
To the maximum extent permitted by law, CCP-M is provided "as is". We are not liable for indirect, consequential, or purely economic losses. Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud.
11. Termination
You may close your account at any time from account settings. On closure, records subject to retention obligations (see Privacy Policy) are archived, not destroyed. We may suspend an account for material breach of these Terms after reasonable notice, except where immediate suspension is necessary to protect the Service or its users.
12. Governing law
These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes
Material changes are announced at least 30 days in advance by email. Continued use after the effective date constitutes acceptance.
